These Terms and Conditions ("Terms") govern your use of Forge Constellation ("the Software"), provided by Meanwhile VOF ("the Seller," "we," "us," or "our"). By purchasing, downloading, or using the Software, you agree to be bound by these Terms.
1. Acceptance
By purchasing or using Forge Constellation, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Software.
2. The Software
Forge Constellation is a suite of seven offline, browser-based creative tools ("Forges") for writers, game designers, songwriters, and worldbuilders. The Software runs locally on your hardware and does not require an internet connection for core functionality. AI features are powered by Ollama, a free, open-source local language model server that you install and manage independently.
3. Licence
Upon purchase, we grant you a perpetual, non-exclusive, non-transferable licence to use Forge Constellation on any number of devices you personally own or control. This licence covers all updates within the current major version (1.x). You may not sublicense, resell, or redistribute the Software itself.
4. Intellectual Property
All intellectual property rights in the Software — including source code, documentation, design, and branding — remain the exclusive property of Meanwhile VOF. Everything you create using the Software is 100% yours. We claim no rights over your creative output.
5. Restrictions
You must not: use the Software for any unlawful purpose; reverse-engineer, decompile, or disassemble the Software; redistribute or resell the Software or any of its components; use the Software to create a competing product; attempt to circumvent any technical limitations or security measures.
6. Payment & Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. For payment, billing, tax, cancellation, and refund mechanics, please refer to Paddle's Buyer Terms .
7. Service Level
The Software is provided as offline, self-contained HTML files. We do not guarantee uninterrupted or error-free performance. Because the Software runs entirely on your hardware, availability depends on your own system.
8. Suspension & Termination
We may suspend or terminate your licence if you: materially breach these Terms; use the Software for fraudulent or illegal purposes; redistribute or resell the Software; or engage in repeated or serious policy violations.
9. Warranties & Liability
The Software is provided "as is" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. To the fullest extent permitted by law, our aggregate liability is limited to the amount you paid for the Software. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
